Terms of Use

1. Acceptance of Terms

By accessing or using Be Delusional, you agree to be bound by these Terms of Use. If you do not agree, you may not use the Service. Be Delusional is operated by Be Delusional Inc., a Delaware corporation ("we," "us," or "our"). These Terms apply to all users, regardless of location.

2. Description of Service

Be Delusional is a subscription-based mobile and web app that uses third-party artificial intelligence to help you turn personal goals and ambitions into structured next-step plans, daily reminders, and visualizations. We do not develop or train the underlying AI models — they are operated by third parties under their own terms and policies. Be Delusional is a coaching and motivation product. It is not a medical, psychiatric, therapeutic, legal, or financial service.

3. Not Professional Advice

Be Delusional does not provide medical, mental-health, therapeutic, legal, financial, or other professional advice, diagnosis, or treatment. The plans and suggestions generated by the Service are informational and motivational only. If you are experiencing a crisis, or you need clinical care, contact a licensed professional or your local emergency services. Do not rely on Be Delusional for decisions that materially affect your health, safety, finances, or legal rights.

4. Eligibility

You must be at least 18 years of age to create an account and use Be Delusional. By registering, you represent and warrant that you meet this requirement and that the information you provide is accurate and complete. We reserve the right to terminate accounts found to be in violation of this requirement.

5. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@bedelusional.co if you suspect any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account information.

6. Permitted Uses

Be Delusional is designed for personal goal-setting, motivation, creativity, and lawful self-development. You are solely responsible for ensuring that your use of the Service and any plans or content you generate comply with all applicable laws and respect the rights of others.

7. Prohibited Content and Uses

You agree not to use Be Delusional to generate, request, distribute, or facilitate any content or activity that:

• Plans, encourages, or provides instructions for self-harm, suicide, or harm to others.
• Plans or facilitates illegal acts, fraud, harassment, stalking, or violence.
• Targets, coaches, or solicits anyone under 18.
• Pretends to deliver medical, psychiatric, therapeutic, legal, or financial advice as a substitute for a licensed professional.
• Impersonates another real person or organization to deceive, defraud, or harm them.
• Attempts to circumvent or disable the content-safety systems of Be Delusional or the underlying AI providers.

Violations may result in immediate account suspension or termination without refund, and may be reported to relevant authorities where required by law.

8. Content Ownership

You retain ownership of the dreams, goals, and inputs you submit to the Service. You are solely responsible for the content you generate and for ensuring it does not infringe on the rights of third parties. Be Delusional does not claim ownership of your personal plans but reserves the right to remove any content that violates these Terms.

9. Subscriptions and Billing

Be Delusional offers subscription plans billed on a recurring basis after an optional free trial. By subscribing, you authorize us to charge your payment method at the start of each billing period. Subscriptions renew automatically unless cancelled before the renewal date. You can manage or cancel your subscription at any time from your account settings or your app-store account. Cancellation takes effect at the end of the current billing period — you will retain access through that date.

10. Free Trial

If you start a free trial, you may use the paid features for the duration of the trial at no charge. If you do not cancel before the trial ends, you will be automatically charged for the subscription plan you selected. Trial eligibility is limited to one trial per user.

11. Refund Policy

We offer a refund on your initial subscription charge if requested within seven (7) days of the charge, provided the Service has not been used meaningfully during that period. Refunds do not apply to renewal charges, and accounts terminated for violations of Section 7 are not eligible for refunds. Where the Service is purchased through an app store (Apple App Store or Google Play), refunds are governed by that store's policy. To request a refund, contact us at support@bedelusional.co.

12. Third-Party AI Models

The AI capabilities behind Be Delusional are operated by independent third parties. We do not control the outputs of these models and do not assume responsibility for them beyond our obligations under these Terms. Each provider's terms and acceptable-use policies apply to your use of those models through the Service.

13. Service Availability

We strive to maintain continuous availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by downtime.

14. Enforcement and Termination

We reserve the right, at our sole discretion, to suspend or terminate your access at any time for conduct that violates these Terms or is otherwise harmful to users, third parties, or the integrity of the Service. We reserve the right — but not the obligation — to monitor use for compliance with these Terms.

15. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, accuracy of generated plans, or non-infringement. We do not warrant that the Service will meet your requirements or produce specific results.

16. Limitation of Liability

To the fullest extent permitted by law, Be Delusional and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the three (3) months preceding the claim.

17. Modifications to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated date. For material changes, we will make reasonable efforts to notify active users. Continued use of the Service after changes constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
